Mediation is an alternative procedure (method) of resolving disputes or cases, an extrajudicial activity now regulated by Law No 06\/L-009 on Mediation, applied voluntarily by two or more conflicting parties with the help of one or more mediators. It is a faster, easier and cheaper procedure or specialized activity than judicial procedures. A mediator is a third, impartial person, licensed by the Ministry of Justice, selected to mediate between parties to resolve the disputes or cases they have, in accordance with the principles and the rules of mediation, defined by the law referred above and other sub-legal acts.<\/p>\n

N\u00eb vitin 2008 p\u00ebr her\u00eb t\u00eb par\u00eb n\u00eb Republik\u00ebn e Kosov\u00ebs u aprovua Ligji i par\u00eb p\u00ebr Nd\u00ebrmjet\u00ebsim (Nr 03\/L-057) duke v\u00ebn\u00eb bazat e para t\u00eb institucionalizimit t\u00eb nd\u00ebrmjet\u00ebsimit si procedur\u00eb n\u00eb Kosov\u00eb. N\u00eb periudh\u00ebn para k\u00ebsaj dhe m\u00eb pas n\u00eb fillimet e saj, implementimi i k\u00ebsaj procedure dhe qasja praktike n\u00eb t\u00eb u p\u00ebrkrah nga donator dhe partner zhvillimor t\u00eb ndrysh\u00ebm si Partners Kosova – Qendra p\u00ebr Menaxhimin e Konflikteve, Agjensioni i Shteteve t\u00eb Bashkuara p\u00ebr Zhvillim Nd\u00ebrkomb\u00ebtar (USAID), Organizata p\u00ebr Siguri dhe Bashk\u00ebpunim n\u00eb Europ\u00eb n\u00eb Kosov\u00eb (OSBE), Misioni i Administrat\u00ebs s\u00eb P\u00ebrkohshme t\u00eb Kombeve t\u00eb Bashkuara n\u00eb Kosov\u00eb (UNMIK), Programi p\u00ebr Zhvillim i Kombeve t\u00eb Bashkuara n\u00eb Kosov\u00eb (UNDP), Bashkimi Europian n\u00eb Kosov\u00eb (BE), CSSP Qendr\u00ebn e Berlinit p\u00ebr Nd\u00ebrmjet\u00ebsim Integrues (CSSP) dhe Qendra p\u00ebr Zgjidhjen Alternative t\u00eb Kontesteve \u2013 Qendra p\u00ebr Nd\u00ebrmjet\u00ebsim Mitrovic\u00eb (ADRC \u2013 MCM). Nj\u00eb num\u00ebr i k\u00ebtyre akterve si USAID, INL, ADRC \u2013 MCM vazhdojn\u00eb t\u00eb jen\u00eb t\u00eb angazhuara dhe mb\u00ebshtesin nd\u00ebrmjet\u00ebsimin n\u00eb Kosov\u00eb.<\/p>\n

The first Mediation Centers in Kosovo (as mechanisms or structures that operationalize mediation and make the procedure accessible, organize and administer the referral\/acceptance of disputes or cases from courts and prosecutions and establish accompanying processes in the country, enable self-referred\/out-of-court mediation and assemble mediators under regional umbrellas) were opened in 2011 and 2012 in Ferizaj, Gjakova, Peja and Gjilan and then in Pristina and Mitrovica in 2013 and Prizren in 2014.<\/p>\n

Nd\u00ebrsa, nd\u00ebrmjet\u00ebsuesit e par\u00eb n\u00eb Kosov\u00eb jan\u00eb licencuar n\u00eb 2011 nga Ministria e Drejt\u00ebsis\u00eb, gjenerata e dyt\u00eb n\u00eb 2014 dhe e fundit t\u00eb licencuar n\u00eb vitin 2017. Trajnimi i tyre u mb\u00ebshtet kryesisht nga akter\u00eb vendor\u00eb dhe nd\u00ebrkomb\u00ebtar (USAID dhe ADRC \u2013 MCM, EU, UNDP, CSSP, Partners Kosova) n\u00eb bashk\u00ebpunim me Komisionin p\u00ebr Nd\u00ebrmjet\u00ebsim. Ata\/o u certifikuan nga Komisioni p\u00ebr Nd\u00ebrmjet\u00ebsim dhe u licencuan nga Ministria e Drejt\u00ebsis\u00eb. Tani, n\u00eb Kosov\u00eb ka, sipas Regjistrit t\u00eb Nd\u00ebrmjet\u00ebsuesve t\u00eb Kosov\u00ebs t\u00eb vitit 2017, 189 nd\u00ebrmjet\u00ebsues\/e t\u00eb regjistruar dhe licencuar.<\/p>\n

To ensure the stability of mediation in Kosovo and pending a new mediation law in the country, the Kosovo Judicial and Prosecutorial Councils began in 2017 and 2018, appointing officials or clerks within Basic Courts and Prosecutions responsible for the court and prosecution-related mediation. This marks the beginning of the transfer or integration of the mediation activity or work from the centres to courts and prosecutions.<\/p>\n

Ligji i ri Nr 06\/L-009 p\u00ebr Nd\u00ebrmjet\u00ebsim ka hyr\u00eb n\u00eb fuqi n\u00eb vitin 2018, duke sjell\u00eb risi dhe reforma n\u00eb procedur\u00eb si dispozitat p\u00ebr integrimin e nd\u00ebrmjet\u00ebsimit n\u00eb gjykata dhe prokurori p\u00ebrmes zyrtar\u00ebve p\u00ebr nd\u00ebrmjet\u00ebsim dhe hap\u00ebsirave t\u00eb dedikuara p\u00ebr nd\u00ebrmjet\u00ebsim brenda k\u00ebtyre institutcioneve, p\u00ebr nd\u00ebrmjet\u00ebsimin e detyruesh\u00ebm, nd\u00ebrmjet\u00ebsimin online, themelimin e Od\u00ebs s\u00eb Nd\u00ebrmjet\u00ebsuesve,  ekzekutueshm\u00ebrin\u00eb e marr\u00ebveshjeve t\u00eb arritura n\u00eb procedur\u00eb t\u00eb nd\u00ebrmjet\u00ebsimit (n\u00eb m\u00ebnyr\u00eb specifike atyre t\u00eb arritura n\u00eb procedur\u00ebn e nd\u00ebrmjet\u00ebsimit me vet\u00eb-inicim t\u00eb pal\u00ebve). Tani, nd\u00ebrmjet\u00ebsimi zhvillohet n\u00eb baz\u00eb t\u00eb k\u00ebtij ligji t\u00eb ri t\u00eb nd\u00ebrmjet\u00ebsimit dhe akteve tjera n\u00ebnligjore q\u00eb kan\u00eb hyr\u00eb n\u00eb fuqi n\u00eb periudh\u00ebn 2019 \u2013 2021.<\/p>\n

On November 2, 2019, the Ministry of Justice organized for the first time an Assembly for the Establishment of the Chamber of Mediators, and on November 17, the Chamber of Mediators of the Republic of Kosovo was established and its bodies elected:<\/p>\n
